Gerringong Land Sale Ordinance 1997

        Long Title

        An Ordinance to permit the sale of certain land at Gerringong, to provide for the application of the proceeds and for incidental matters.

        Preamble

        Whereas

        A. Anglican Church Property Trust Diocese of Sydney (the "Property Trust") is the registered proprietor of the whole of the land (the “Land”) in Certificate of Title Volume 14773 Folio 106.

        B. By Ordinance No. 24 of 1930 the Land may be used for the purpose of a Church and/or a school hall and/or a residence and such residence may be used as a residence for a Clergyman or catechist or may be leased for any term not exceeding five (5) years at such rents fixed or progressive and subject to such conditions as the Churchwardens for the time being of St George's Church shall think fit and the net rents arising from such leasing may be received and used by such Churchwardens for the use and benefit of the said Parish at Gerringong and as parochial Church funds not excluded from their charge or administration.

        C. The Council of the Municipality of Kiama wishes to acquire part of the Land for road widening purposes.

        D. It is expedient that part of the Land be sold and the proceeds applied as hereinafter set out.

        The Standing Committee of the Synod of the Diocese of Sydney Ordains as follows -

        Name of Ordinance

        1. This Ordinance is the Gerringong Land Sale Ordinance 1997.

        Declaration

        2. By reason of the circumstances which have arisen after the creation of the trusts upon which that part of the Land described in the Schedule is held, it is expedient that that part of the Land be sold and that the proceeds be applied as hereinafter set out.

        Power of Sale

        3. The Property Trust is authorised to sell that part of the Land described in the Schedule to Kiama Municipal Council for such price or prices and subject to such terms and conditions as to the Property Trust may seem appropriate.

        Application of Proceeds

        4. The proceeds arising from the sale after paying thereout the costs of and incidental to this Ordinance, the costs of and incidental to any necessary subdivision and the cost of and incidental to the sale shall be paid to the churchwardens of St George’s Church, Gerringong and applied by them for the reduction of the indebtedness of the Provisional Parish.

        Schedule

        All that piece or parcel of land at Gerringong being the land marked "area to be acquired" on Plan 1369 prepared by Kiama Council dated November 1996 and being part of the land on Certificate of Title Volume 14773 Folio 106.
