Manly Vale with Allambie Heights Leasing Ordinance 1998

        Long Title

        An Ordinance to authorise the leasing of land at Manly Vale and to provide for the application of the income.

        Preamble

        A. Anglican Church Property Trust Diocese of Sydney (the “Property Trust”) is the registered proprietor of the land in Folio Identifier 52/7568 (the “Land”).

        B. By clause 2 of the St Peter’s Manly Vale Variation of Trust and Mortgage Ordinance 1964, the land is held upon trust to permit the same to be used for a church, parsonage or parish hall or partly for one and partly for another or others of such purposes in connection with the Church of England in Australia at Manly Vale in the Provisional District of All Saints Balgowlah with St Peter’s Manly Vale or any provisional parish or parish into which it may subsequently be formed or form a part.

        C. The land is now situated in the parish of Manly Vale with Allambie Heights (the “Parish”).

        D. The Parish proposes that the Property Trust lease the residence known as, 1 King Street, Manly Vale (the “Residence”) erected on the Land.

        E. By reason of circumstances which have arisen after the creation of the trusts on which the Land is held it is expedient that the Land be leased and the income applied in the manner set out in this ordinance.

        The Standing Committee of the Synod of the Diocese of Sydney Ordains as follows -

        Name

        1. This Ordinance is the Manly Vale with Allambie Heights Leasing Ordinance 1998.

        Declaration of Expediency

        2. By reason of circumstances which have arisen after the creation of the trusts on which the Land is held it is expedient that the Land be leased and the income applied in the manner set out in this ordinance.

        Authority to Lease

        3. The Property Trust is hereby authorised to lease the Land upon such terms and conditions as it considers appropriate upon request by the churchwardens of St Peter’s Church, Manly Vale (the “Churchwardens”).

        Application

        4. The income received from any lease must be paid to the Churchwardens and be applied by them for the purposes consistent with the trusts on which the Land is held.
