Kurrajong Land Transfer Ordinance 1996

        Long Title

        An Ordinance to authorise the transfer of land at Kurrajong to Hawkesbury Shire Council.

        Preamble

        A. By deed dated 3 November 1873 being Registered Conveyance No. 715 Book 139 the land (“Land”) described in the schedule was conveyed to the Bishop of Sydney and his successors.

        B. The Land is church trust property and by the deed referred to in A the Land is held on trust ”to permit and suffer the same to be used occupied and enjoyed as a Minister’s dwelling and Glebe in connection with the Church of England situated at Kurrajong in the county of Cook in the colony of New South Wales.”

        C. It is desirable to vest the Land in Anglican Church Property Trust Diocese of Sydney (the “Property Trust”).

        D. It is expedient that the Land be transferred to Hawkesbury City Council.

        The Standing Committee of the Synod of the Diocese of Sydney Ordains as follows -

        Name of Ordinance

        1. This ordinance is the Kurrajong Land Transfer Ordinance 1996.

        Vesting of Property

        2. Consent is given to the Land vesting in the Property Trust.

        Declaration of Expediency

        3. By reason of circumstances which have arisen after the creation of the trusts upon which the Land is held it is expedient that the Land be transferred to Hawkesbury City Council.

        4. The Property Trust is authorised to transfer the Land, free from the trusts on which the Land is held, to Hawkesbury City Council for no consideration.
