Long Title

An Ordinance to authorise the sale of certain land at Chatswood and the application of the proceeds of sale.

Preamble

A. By Will made 26 May 1983 Denzil Neville gave the rest and residue of his estate to the Trustees of St Paul’s Anglican Church Chatswood for the general purposes of such Church.

B. The residue of the estate includes the land comprised in Certificate of Title Volume 15070 Folio 18 upon which is erected a residence known as 2A Critchett Road, Chatswood (the “Land”).

C. Anglican Church Property Trust Diocese of Sydney (the “Property Trust”) is now the registered proprietor of the Land.

D. By reason of circumstances which have arisen after the creation of the trusts on which the Land is held it is expedient that the Land be sold and the proceeds to be applied as provided for in this Ordinance.

The Standing Committee of the Synod of the Diocese of Sydney Ordains as follows -

Name

1. This Ordinance is the Chatswood Land Sale Ordinance 1998.

Declaration of Inexpediency

2. By reason of circumstances which have arisen after the creation of the trusts on which the Land is held it is expedient that the Land be sold but it is inexpedient that the proceeds of sale be applied solely for the same or like purposes as the trusts on which the Land is held.

Sale Authority

3. (1) The Property Trust is empowered to sell the Land by public auction or private contract at such time and at such price upon and subject to such terms and conditions as it may think fit.

(2) No such sale may be effected after the 3rd anniversary of the date on which assent is given to this Ordinance without the consent of the Standing Committee given by resolution.

Application of Proceeds

4. After the payment of all outgoings to which the Land may be subject, including the costs of and incidental to the promotion of this Ordinance and the sale of the Land, the balance of the proceeds of sale shall be applied by the Property Trust, following a request made pursuant to a resolution of the parish council of the parish of Chatswood, towards the costs of the acquisition of a residence suitable for use as a residence for an assistant minister or any person employed by the churchwardens of St Paul’s Church Chatswood to conduct ministry in the parish of Chatswood.
