Long Title

An Ordinance to authorise the leasing of certain land at Berowra and to provide for the application of the rents.

Preamble

A. Anglican Church Property Trust Diocese of Sydney (the “Property Trust”) is the registered proprietor of the land (the “Land”) described in the Schedule.

B. By clause 2(2) of the Berowra Ordinance 1993 the Land is held upon trust for the Anglican Church of Australia in the provisional parish of Berowra (the “Provisional Parish”).

C. By reason of circumstances which have arisen after the creation of that trust, it is expedient that the Land be leased.

The Standing Committee of the Synod of the Diocese of Sydney Ordains as follows -

Name of Ordinance

1. This ordinance is the Berowra Leasing Ordinance 1996.

Declarations of Expediency

2. By reason of circumstances which have arisen after the creation of the trust on which the Land is held, it is expedient that the Land be leased.

Power to Lease

3. The Property Trust is authorised and empowered to grant a lease or leases over the whole or any part or parts of the Land provided that the term of such lease or leases must expire prior to the 8th anniversary on the date on which assent is given to this Ordinance.

Application of Proceeds

4. The rents from such lease or leases must be applied -

(a) first, in repayment of moneys lent and applied in effecting improvements to buildings on land held on trust for the Provisional Parish;

(b) thereafter, as approved by the Standing Committee by resolution thereof.

Schedule

The land comprised in Certificate of Title Volume 1506 Folio 119 and to be comprised in Folio Identifier 1/3/758096 being Lot 1 of Section 3 in Deposited Plan 758096 and known as 16 Berowra Waters Road.
