Long Title

An Ordinance to authorise the granting of a drainage easement over land at Narraweena.

Preamble

A. Anglican Church Property Trust Diocese of Sydney (the “Property Trust”) is the registered proprietor of the whole of the land contained in Folio Identifier 1/585261 known as 9 Janice Place, Narraweena (the “Land”).

B. The Land is held on trust for the purposes of the parish of Beacon Hill (the “Parish”) although no trusts have been declared in writing.

C. By reason of circumstances which have arisen after the creation of the trusts on which the Land is held it is expedient that the Property Trust be authorised to grant an easement for drainage over part of the Land.

The Standing Committee of the Synod of the Diocese of Sydney Ordains as follows -

Name

1. This Ordinance is the Beacon Hill Easement Ordinance 1998.

Declaration of Inexpediency

2. By reason of circumstances which have arisen after the creation of the trusts on which the Land is held, it is expedient that authority be given for an easement for drainage to be granted over the Land.

Grant of Easement

3. The Property Trust is authorised to grant an easement for drainage over the Land on such terms and conditions as may be approved by a majority of the parish council of the Parish.

4. After payment of all expenses incidental to the grant of easement and incurred in the passing of this Ordinance, the Property Trust shall pay all moneys as a consequence of the grant of easement to the churchwardens of Holy Trinity Church Beacon Hill to be applied for the purposes of the Parish.
