Long Title

An Ordinance to authorise the Property Trust to enter an agreement for the execution of certain works at All Souls Church, Leichhardt.

Preamble

A. The Property Trust is the trustee of the land described in Part 1 of the Schedule to this ordinance.

B. The church building named in part 2 of the Schedule to this ordinance (the “Building”) has been erected on the land described in Part 1 of the Schedule.

C. The land described in Part 1 of the Schedule to this ordinance is held upon the trust specified in Part 3 of the Schedule.

D. The control and administration of the building named in Part 2 of the Schedule, by virtue of the Church Administration Ordinance 1990 and the Church Grounds & Buildings Ordinance 1990 (collectively the “Ordinances”) is not vested in the Property Trust.

E. The Commonwealth of Australia (the “Commonwealth”) is willing to execute certain insulation works in the building named in Part 2 of the Schedule.

F. The arrangements as to the control and administration of the building needs to be modified to permit the insulation works to be executed.

The Standing Committee of the Synod of the Diocese of Sydney Ordains as follows -

1. Name

This Ordinance is the Aircraft Noise (All Souls Leichhardt) Ordinance 1999.

2. Authority

The Property Trust is authorised to enter into an agreement with the Commonwealth in relation to the Building for noise insulation works to be undertaken on the Building by the Commonwealth.

3. Carrying out of Works

(1) The Property Trust in such an agreement may make such arrangements for the Commonwealth and its contractors and their subcontractors to have access to the Building at such times as it or they may require.

(2) All rights conferred by the Ordinances are subject to such arrangements.

(3) Clauses 5, 9 and 10 of the Church Grounds & Buildings Ordinance 1990 do not apply to any works done pursuant to any agreement made by the Property Trust with the Commonwealth pursuant to clause 2.
