St Mary's Balmain (Consolidation) Ordinance 1990 Amendment Ordinance 1993

An Ordinance to amend the St Mary's Balmain (Consolidation) Ordinance 1990 and to vary the trusts on which certain money is held.

Whereas

A. A sum of money is held by the Property Trust and is invested under the St Mary's, Balmain (Consolidation) Ordinance 1990 ("the Principal Ordinance") upon the trusts set out in that ordinance.

B. Clause 4 of the Principal Ordinance requires the churchwardens of St Mary's Church, Balmain, to present an ordinance to provide for the distribution of the money invested under the Principal Ordinance or the income arising from the investment, or both, having regard to the needs and commitments of the Provisional Parish of St Mary's, Balmain, and organisations within the Diocese of Sydney and to do so within 3 years after the date of assent to the Principal Ordinance, that is, by 24 September 1993.

C. The Provisional Parish, having regard to the provisions of clause 9(a) of the Inner City Ordinance 1972, submitted a proposal for the expenditure of the money to the Inner City Committee at the beginning of May, 1993, but no report concerning the proposal has been made by the Committee pending its investigation of the mid-term needs of ministry in a group of 6 adjoining parishes, including the Provisional Parish.

D. By reason of circumstances which have arisen after the creation of the trusts on which the money is held it is inexpedient to carry out and observe those trusts and it is expedient that they be varied as set out in this ordinance.

Now the Standing Committee of the Synod of the Diocese of Sydney in the name and place of the said Synod Ordains as follows.

1. This ordinance may be cited as the "St Mary's Balmain (Consolidation) Ordinance 1990 Amendment Ordinance 1993".

2. The Principal Ordinance is amended by deleting from clause 4 the matter "3 years" and by inserting instead the matter "5 years".
