Moorebank (Grant of Easements) Ordinance 1993

An Ordinance to authorise the grant of easements over church trust property at Moorebank.

Whereas

A. The Property Trust is the registered proprietor of the land ("Land") being Lot 1 in Deposited Plan 524135 and being the land in Nuwarra Road, Moorebank on which St Thomas' Church Moorebank is situated.

B. The Land is held upon trust for the Anglican Church Diocese of Sydney in the parish of Moorebank ("Parish"), although there are no written trusts.

C. By reason of circumstances which have arisen after the creation of the trusts on which the Land is held it is inexpedient to carry out and observe those trusts and it is expedient that the trusts be varied in the manner set out in this ordinance.

Now the Standing Committee of the Synod of the Diocese of Sydney in the name and place of the said such Synod Declares, Rules, Ordains and Directs as follows -

1. This ordinance may be cited as the "Moorebank (Grant of Easements) Ordinance 1993".

3. The Property Trust is hereby empowered to execute documents to grant easements over the Land upon such terms and conditions agreed upon with the consent and at the request of the majority of the parish council of the Parish.

4. The proceeds from the grant of any easement authorised by this ordinance shall be paid to the churchwardens of the St Thomas' Church Moorebank and applied by them for parish purposes.
