East Sydney (St Peter's Sale Proceeds) Ordinance 1994

Long Title

An Ordinance to authorise the application of the proceeds of sale of certain land at Darlinghurst.

Preamble

Whereas

A. The East Sydney Ordinance 1992 ("1992 Ordinance") authorised the sale of the land ("Land") which was the site (inter alia) of St Peter's church and hall Darlinghurst.

B. Clause 3 of the 1992 Ordinance provides that the proceeds from the sale of the Land were to be applied in or towards the payment of certain costs and any balance remaining was to be applied for such charitable purposes of the Anglican Church of Australia in the Diocese (including the Parish of East Sydney (the "Parish")) as the Synod or the Standing Committee determines by ordinance presented on behalf of the parish council of the Parish after completion of the sale of the Land and within 3 years of the sale.

C. The Land has now been sold and this ordinance is promoted on behalf of the parish council of the Parish in accordance with clause 3 of the 1992 Ordinance.

Now the Standing Committee of the Synod of the Diocese of Sydney in the name and place of the said Synod Hereby Ordains Declares Directs and Rules as follows.

Citation

1. This ordinance may be cited as the "East Sydney (St Peter's Sale Proceeds) Ordinance 1994".

Application of Proceeds

2. Of the part proceeds of sale of the Land paid to date, after payment of the costs referred to in clause 3 of the 1992 Ordinance $50,000 shall be applied toward the acquisition of a residence in the inner city area for an aboriginal pastor in conjunction with any other body established by or recognised under any ordinance of Synod or the Standing Committee. Upon acquisition the Property Trust shall hold that proportion of the title as $50,000 is to the purchase price upon trust for the Parish. The Parish shall be responsible for a similar proportion of all outgoings, maintenance and necessary repairs. The balance shall be applied in accordance with a further ordinance of the Standing Committee.
