Greenacre Ordinance 1999

Long Title

An Ordinance to vary the trusts on which certain funds are held.

Preamble

A. The Property Trust holds certain funds (the “Funds”) upon the trusts set out in the Punchbowl with Greenacre Land Sale Ordinance 1996 (the “Principal Ordinance”).

B. The churchwardens of St Barnabas’ Punchbowl are required to promote an ordinance to deal with the Funds under clause 6 of the Principal Ordinance.

C. The churchwardens of Greenacre Anglican Church, Greenacre assumed responsibility for the Funds upon the deconsecration of St Barnabas’ Punchbowl.

D. The parish of Punchbowl with Greenacre is now known as the parish of Greenacre (the “Parish”).

E. By reason of circumstances which have arisen after the creation of the trusts on which the Funds are held it is inexpedient to carry out and observe the trusts and it is expedient to vary the trusts on the terms set out in this Ordinance.

The Standing Committee of the Synod of the Diocese of Sydney Ordains as follows -

1. Name

This Ordinance is the Greenacre Ordinance 1999.

2. Declarations

By reason of circumstances which have arisen after the creation of the trusts on which the Funds are held it is inexpedient to carry out and observe those trusts and it is inexpedient that the Funds be applied in their entirety for the same or like purposes as the trusts upon which they are presently held.

3. Application of Funds

The Property Trust is authorised to apply from the Funds in the following priorities -

(a) a sum not exceeding of $20,000 in payment of arrears of parish assessments.

(b) a sum not exceeding $85,000 towards undertaking renovation extension and maintenance work to Greenacre Anglican Church, Greenacre;

(c) a sum not exceeding $84,000 towards the stipend allowances and necessary expenses in employing a full time Youth Minister.

(d) the balance toward such purposes of the Parish authorised by the Standing Committee by resolution at the request in writing of a majority of the parish council of the Parish.

4. Investment

Pending application of the Funds or any part thereof under clause 3, the Property Trust must invest the same and capitalise the income earned on the investment.
