Gilbulla Memorial Conference Centre Sale Ordinance 2001 No 45, 2001 Long Title An ordinance to authorise the sale of the Gilbulla Memorial Conference Centre at Menangle and provide for the application of the proceeds of sale. Preamble A. Anglican Church Property Trust Diocese of Sydney is the registered proprietor of the land (the "Land") described in Certificate of Title Volume 7667 Folio 30, being lot 1 in deposited plan 370921 and lot A in deposited plan 407248. B. By clause 16 of the "Gilbulla" Board of Management Constitution Ordinance 1962 the land is held upon trust to permit the same to be used as a conference centre and retreat house in connection with the Anglican Church in the Diocese of Sydney and for purposes incidental to the conduct thereof. C. By reason of circumstances which have arisen after the creation of the trusts upon the Land is held, it is expedient that the Land be sold and that the proceeds of sale be applied in the manner set out in this ordinance. The Synod of the Diocese of Sydney ordains as follows. 1. Name of ordinance This ordinance is the Gilbulla Memorial Conference Centre Sale Ordinance 2001. 2. Declarations By reason of circumstances which have arisen after the creation of the trusts on which the Land is held it is expedient that the Land be sold and proceeds of sale applied in the manner set out in this ordinance. 3. Sale of the Land The Property Trust is authorised to sell the Land by public auction or by private contract at such time or times, at such price or prices, and upon and subject to such terms and conditions as it may think fit at any time within 3 years after the date of assent to this ordinance. 4. Application of the proceeds of sale The proceeds arising from the sale of the Land, after the payment of all costs of and incidental to the promotion of this ordinance and the sale of the Land, are to be applied as follows -
Any change to this clause shall require an Ordinance of the Synod. 5. Naming and memorial Any new Anglican conference facility acquired from the proceeds of this sale is to be named and maintained in memory of Navy, Army and Air Force Chaplains.
