Robertson (Burrawang) Variation of Trusts and Vesting Ordinance 2002

Long Title

An Ordinance to vary the trusts and consent to the vesting of land known as St David's church site, Church Street, Burrawang in Anglican Church Property Trust Diocese of Sydney.

Preamble

A. The Archbishop of Sydney is the registered proprietor of Lot 1 in Deposited Plan 1033348 known as St David's church site, Church Street, Burrawang (the "Land").

B. By Deed Book 205 Number 909 the Land is held upon trust for the erection and maintenance thereon of a church for the celebration of public worship according to the use of the Church of England and also a parsonage and other necessary erections for the occupation of the minister from time to time officiating at such church.

C. By reason of circumstances which have arisen after the creation of trusts on which the Land is held it is inexpedient to carry out or observe those trusts and it is expedient to vary those trusts in the manner set out in this Ordinance.

D. Under section 19 of the Anglican Church of Australia Trust Property Act 1917 it is expedient to consent to the vesting of the land in Anglican Church Property Trust Diocese of Sydney, the corporate trustee of the Diocese of Sydney.

The Standing Committee of the Synod of the Diocese of Sydney Ordains as follows.

1. Name

This Ordinance is the Robertson (Burrawang) Variation of Trusts and Vesting Ordinance 2002.

2. Declarations

By reason of circumstances which have arisen after the creation of trusts on which the Land is held it is inexpedient to carry out or observe those trusts or to deal with or apply the Land for the same or like purposes as those trusts and it is expedient to vary those trusts in the manner set out in this Ordinance.

3. New Trusts

The Land is held upon trust for the purposes of the parish of Robertson.

4. Consent

Under section 19 of the Anglican Church of Australia Trust Property Act 1917, consent is given to the Land being vested in Anglican Church Property Trust Diocese of Sydney, the corporate trustee of the Diocese of Sydney.
