An Ordinance to amend the Figtree Mortgaging Ordinance 2001.
A. Anglican Church Property Trust Diocese of Sydney (the "Property Trust") is the registered proprietor of the land comprised in certificate of title folio identifier 21/786520 known as 4-10 Gibsons Road, Figtree (the "Land").
B. The Land is church trust property and by clause 2(2) of the Figtree Mortgaging Ordinance 2001 (the "Principal Ordinance") is held upon trust for a church, parsonage, parish hall, children's ministry centre, auditorium and associated car parking area or partly for one or partly for another or others for such purposes in connection with the Anglican Church of Australia in the parish of Figtree (the "Parish").
C. By clause 3 of the Principle Ordinance the Property Trust is authorised and empowered to mortgage the Land for the purposes of borrowing the sum not exceeding the sum of $1,800,000.
D. The Parish wishes to construct, instead of converting the existing rectory for, a children's ministry centre and increase the borrowing limit in connection with the mortgage of the Land to $2,500,000.
The Standing Committee of the Synod of the Diocese of Sydney Ordains as follows.
This Ordinance is the Figtree Mortgaging Ordinance 2001 Amendment Ordinance 2002.
The Principal Ordinance is amended as follows -
I Certify that the Ordinance as printed is in accordance with the Ordinance as reported.
I Certify that this Ordinance was passed by the Standing Committee of the Synod of the Diocese of Sydney on 18 November 2002.
I Assent to this Ordinance.
