Kellyville (Further Variation of Trusts) Ordinance 2003

Long Title

An Ordinance to to vary the trusts of a fund held by Anglican Church Property Trust Diocese of Sydney.

Preamble

A. Anglican Church Property Trust Diocese of Sydney (the "Property Trust") is the trustee of a fund ("Fund 571") held for the purposes set out in the Kellyville Land Sale Ordinance 1994, the New Sites (Rouse Hill) Ordinance 2002 and the Kellyville Land Sale Ordinance 2002.

B. By reason of circumstances which have arisen after the creation of the trusts on which Fund 571 is held, it is inexpedient to carry out and observe those trusts, and it is expedient that the trusts be varied.

The Standing Committee of the Synod of the Diocese of Sydney Ordains as follows.

1. Name

This Ordinance is the Kellyville (Further Variation of Trusts) Ordinance 2003.

2. Declarations

By reason of circumstances which have arisen after the creation of the trusts on which Fund 571 is held, it is inexpedient to carry out and observe those trusts, and it is expedient that the trusts be varied in the manner set out in clause 3.

3. Variation of trusts

The trusts on which Fund 571 are held are varied to enable the Property Trust to pay any cost recovery charges arrears payable by the parish of Kellyville (the "Parish") at the date of assent to this Ordinance and from time to time, with the approval of the majority of the parish council of the Parish, to pay any further cost recoveries charges (including further arrears of such charges) payable by the Parish.
