Parish Trust Fund (Amendment) Ordinance 2004

Long Title

An Ordinance to amend certain ordinances which establish parish trust funds.

Preamble

A. The ordinances referred to in the Schedule established trust funds for certain parishes prior to 28 April 2003 based on a standard form ordinance approved by the Standing Committee.

B. On 28 April 2003 the Standing Committee made certain changes to the standard form ordinance.

C. It is expedient to amend the ordinances referred to in the Schedule to incorporate the changes made by Standing Committee to the standard form.

D. It is also expedient to further amend the Malabar Trust Ordinance 2001 and the Crestwood Trust Ordinance 2002.

1. Name

This Ordinance is the Parish Trust Fund (Amendment) Ordinance 2004.

2. Amendment

(1) Each ordinance referred to in the Schedule is amended as follows -

(a) re-letter existing clause 6(2)(c) as clause 6(2)(d), and

(b) insert a new clause 6(2)(c) as follows -

“(c) to the extent such personal property arises from a payment made to the Property Trust by the churchwardens of a church in the Parish for the purpose of enabling the Property Trust to make a payment under a contract made or to be made by the Property Trust as trustee of the trust fund with the approval of a majority of the parish council, for that purpose; and”.

(2) The Crestwood Trust Ordinance 2002 is further amended as follows –

(a) delete each occurrence of the word “Crestwood” (except in the Schedule) and insert instead the word “Norwest”, and

(b) delete the word “provisional” in clause 5, and

(c) add the matter “, except the payment of the stipends, allowances and benefits paid or provided to the minister” at the end of clause 7(1)(b), and

(d) delete the matter “5 years” in clause 8(2) and insert instead the matter “10 years”.

(3) The Malabar Trust Ordinance 2001 is further amended by deleting each occurrence of the word “Malabar” (except in the Schedule) and inserting instead the words “Malabar with Lord Howe Island”.
