Long Title
An ordinance to amend the Church Administration Ordinance 1990.
The Synod of the Diocese of Sydney Ordains as follows.
1. Name
This Ordinance is the Church Administration (Heritage Property) Amendment
Ordinance 2001.
2. Amendment of the Church Administration
Ordinance 1990
The Church Administration Ordinance 1990 is amended as follows -
(a) after paragraph (p) of clause 20(1) the following new paragraph
is inserted -
"(pa) if any property of the church is listed on the State
Heritage Register maintained from time to time under the Heritage
Act 1977 (the "Act") -
(i) to maintain and repair the property in accordance with the
minimum standards (if any) prescribed from time to time by the
Act or any regulations made under the Act, and
(ii) where the Property Trust or other trustee is the owner of
that property for the purposes of the Act, to provide within 28
days of receipt of a written request, such information as the
Property Trust or other trustee reasonably requires about compliance
with the requirements of subparagraph (i).", and
(b) at the end of paragraph (i) of clause 28(1) the matter "."
is deleted and the matter ", and" is inserted instead, and
(c) after paragraph (i) of clause 28(1) the following new paragraph
is inserted -
"(j) to do all things as it can reasonably do (including providing
funds) to enable the churchwardens of a church in the parish to
comply with clause 20(1)(pa).", and
(d) paragraph (b) of clause 63(1) is deleted and the following new
paragraph is inserted instead-
"(b) any property of a church or parish is being properly
maintained and repaired and, where any such property is listed on
the State Heritage Register maintained from time to time under the
Heritage Act 1977, clauses 20(1)(pa) and 28(1)(j) are being complied
with, and", and
(e) after clause 63(2) the following new subclause is inserted-
"(3) If -
(a) the churchwardens of a church do not comply with clause 20(1)(pa)(ii),
or the parish council of a parish does not comply with clause
28(1)(j), and
(b) the Property Trust or other trustee notifies the Archdeacon
of that failure,
the Archdeacon is to take all reasonable steps to obtain such
compliance.".
